Housing Appropriations and Bonds

  • H.F. 1637(Clark) / no companion: changes the amount of nonprofit housing bonds the Minnesota Housing Finance Agency may issue; dedicating a portion of bonds issued to permanent supportive housing for victims of human trafficking.
  • S.F. 2078(Metzen) / no companion: Tax increment financing (TIF) requirements modification; loan guarantee fund establishment; nonprofit housing bond issue; second mortgage loan program; sustainable development projects bond issuance; low-income and historic preservation housing tax credits; special assessments for energy improvements; JOBZ program metropolitan area extension.
  • H.F. 2406(Mariani) / S.F. 2165(Marty): Affordable housing, green energy investments and emergency employment development bond issue and appropriation; Minnesota Emergency Employment Development (MEED) Act of 2009

Foreclosure

  • H.F. 0354(Hilstrom) /S.F. 0340(Scheid): Homeowner-Lender Mediation Act - requires mandatory proceedings before the foreclosure of a homestead property. Provides mediation notices to homeowners and requires that the mediation be supervised by the courts and be in good faith.
  • H.F. 0009(Davnie)/S.F. 0242(Anderson): MN Subprime Borrower Relief Act - allows a foreclosed borrower the right to defer a foreclosure sale for one year by providing an affidavit of deferment to the foreclosing lender. Requires monthly payments and the right of the lender to revoke the deferment following good faith negotiations. Requires that the borrower lived and continue to live in the home during the deferment process.
  • H.F. 0333(Mullery) / no companion: MN Foreclosure Remediation Fee Act - Provides for the collection of a $15 fee to rehabilitate and preserve properties that have been affected by foreclosures. Fee would be imposed on each deed by which any real property is conveyed. The county that collects the fee will retain 80 percent of the total fee to pay for foreclosure remediation, and MHFA will receive 20 percent of the total fee to fund foreclosure remediation. The fee would sunset Aug. 1, 2012.
  • S.F. 0335(Mullery) / no companion: a bill that provides for certain trespass and scrap metal sale provisions.
  • H.F. 0626(Bly) / S.F. 0542(Tomassoni): People's Bailout - temporarily lifts a five-year limit on welfare benefits (MFIP). Modifies unemployment compensation, reemployment assistance training and applications for unemployment benefits. Makes technical changes to notification procedures for tenants in foreclosed properties and strengthens the rights of tenants in foreclosed properties. Declares that an economic emergency exists due to the increase in foreclosure rates. Declares that a housing emergency exists that justifies a moratorium on mortgage foreclosures. Establishes a special state emergency unemployment compensation program for those who have exhausted their MN unemployment insurance benefits to be qualified for federally funded unemployment insurance benefits. Requires DEED develop and implement a jobs creation grant program to make grants available to cities and towns for projects that will generate new jobs.
  • H.F. 1184(Champion) / S.F. 1034(Higgins): modifies provisions governing expungement of eviction records; requires landlords to provide receipt for rent paid with cash; modifies tenant rights to possession.
  • H.F. 1489(McFarlane) / no companion: regarding mortgages, provides for notice of sale and postponement.
  • H.F. 1887(Mullery) / no companion: provides for rehabilitation of vacant and abandoned housing due to foreclosure crisis; protects the health, safety, and welfare of the community through appropriate police powers; provides legal process to appoint receivers for abandoned properties and recovery of funds expended to bring property up to code.
  • H.F. 0019(Mullery) / S.F. 1981(Kelash): enables a homeowner to postpone the sheriff's sale for 5 months in exchange for reducing redemption period by 5 months (effectively eliminating the redemption period and replacing it with a reinstatement period).
  • H.F. 0528(Davnie) /S.F. 0489(Clark): provides a 30-day rescission period during which a senior could cancel a reverse mortgage. It also would require lenders to have reasonable grounds for believing that the reverse mortgage is suitable for the borrower, and would limit insurance companies from "cross-selling" products to seniors using the proceeds of a reverse mortgage. Requires counseling about the pros and cons of reverse mortgages.
  • H.F. 1214(Davnie) / S.F. 1035(Higgins): Contract for Deed - clarifies eviction provisions; modifies provisions governing contracts for deed; regulates contracts for deed involving residential property and residential leases with an option to purchase.
  • H.F. 1394 (Hayden) / S.F. 1147(Higgins): specifies notice requirements; modifies provisions governing the reduced redemption period for abandoned property; establishes a duty to protect vacant foreclosed property under certain circumstances; provides for the imposition of fines for failure to maintain property; alters the postings requirement for trespassing on construction sites; modifies provisions governing public nuisances; imposes civil and criminal penalties.

Local Government Housing and Economic Development

  • H.F. 0157(Mullery) / no companion: authorizes zoning for "owner-occupied residential use only" for the purposes of stabilizing neighborhoods and cities.
  • H.F. 1698(Davnie) / S.F. 1552(Kelash): Neighborhood Renewal Act - a person acting on behalf of a state, county, municipality or nonprofit housing organization” could seek from the court an injunction that requires a property owner to rehabilitate a blighted property or the appointment of a receiver to do the same. Helps provide for the rehabilitation of housing that is vacant and abandoned as a result of the foreclosure crisis.
  • H.F. 1296(Mullery) / S.F. 1184(Rest): Brooklyn Park; St. Paul; Fridley; Housing replacement district plan additional authority allowed to spend increments, housing replacement districts establishment authorized, housing replacement district local contribution requirement eliminated, and special laws for housing replacement reauthorized.
  • H.F. 1955(Holberg) / S.F. 1610(Rest): Livable Communities Act - transfers money from two accounts used for housing development and brownsfield remediation to cover transit operating deficits.
  • H.F. 2279(Davnie) / S.F. 2010(Scheid): Home Values Guarantee Pilot Program - creates a pilot program to stabilize market values of residential real estate in certain areas; provides a five-year guarantee against depreciation in value of certain properties; provides incentives to restructure mortgage loans.

Homelessness

  • H.F 1491(Hayden) / S.F. 2026(Dibble): restores the $3 million in one-time funding for long-term homelessness services, $1 million for the Runaway and Homeless Youth Act, and additional monies for transitional housing programs and emergency services grants.
  • H.F. 0556(Morrow) / no companion: continues outreach to homeless veterans in Minnesota, and money appropriated.
  • H.F 1516(Thissen) / no companion: appropriates money for long-term homeless supportive services.
  • S.F 1984(Sheran) / no companion: appropriates money for long-term homeless supportive services.

Affordable Housing Tax Items

  • H.F. 1136(Lenczewski) / S.F. 1777(Senjem): reduces corporate income tax rate; provides green job incentives; establishes small business investment company credit and job growth investment credit; abolishes political contribution refund; changes rent percentage for purposes of property tax refund; modifies capital equipment sales tax exemption; modifies incentive payment for sustainable forest resource management program; provides a federal update; providing for green job opportunity building zones; provides tax credits; allowing tax benefits; makes changes to local government aid, the market value homestead credit, income, franchise, property, sales and use, minerals, and other taxes and tax-related provisions; appropriates money.
  • H.F. 1661(Loeffler) /S.F. 0490(Pogemiller): provides that certain elderly living facilities are exempt from property taxation; provides an exemption for the purchase of materials and supplies used in the construction of certain elderly facilities from sales taxation.
  • H.F. 0044(Lesch) / no companion: authorizes tax abatement for property owners with Housing Choice Voucher contracts located in low poverty areas.
  • H.F. 1507(Sanders) / no companion: exempts certain residential mortgages from the mortgage tax.
  • H.F. 1508(Sanders) / no companion: exempts certain residential mortgages for first-time homebuyers from the mortgage tax.

  • H.F. 0923(Carlson) / S.F. 0828(Rest): eliminates the one-year lag in determining fiscal disparities contribution net tax capacities and distribution levies with regard to property taxes.
  • S.F. 0517(Ortman) / no companion: provides a property tax cap for long-term homeowners age 65 or older.
  • S.F. 1340(Scheid) / no companion: establishes a limit on senior homeowners' property taxes as a percentage of household income.
  • H.F. 2204(Marquart) / no companion: enhances the property tax refund and reduces the market value homestead credit.

  • S.F. 0170(Saltzman) / no companion: augments remedies for breach of contract cost recovery on statutory housing warranties.
  • H.F. 0211(Swails) / no companion: civil action provisions for breach of contract cost recovery on statutory housing warranties.
  • H.F. 0275(Laine) / no companion: prohibits nonrenewal of homeowner’s insurance in certain cases.
  • H.F. 0420(Laine) / S.F. 0776(Latz): requires that existing statutory implied residential construction warranties be made express warranties and be provided to the buyer in writing.
  • H.F. 2060(Sterner) / S.F. 1886(Saltzman): regulates public adjusters; modifies the notice or cancellation and prohibited practices; regulates insurance claims for residential roofing goods and services.
  • H.F. 0027(Brod) / no companion: limits reconstructed housing assessment values after a disaster.

Rental Strategies

  • H.F. 0076(Lesch) / no companion: landlords may not charge a tenant screening fee without using a uniform residential tenant report.
  • H.F. 0077(Mullery) / no companion: requires landlords to refund potential tenants screening fees within two weeks under certain conditions.
  • H.F. 1829(Mullery) / no companion: regulates contracts for deed and rental purchase agreements; providing attorney fees and other remedies.
  • H.F. 1906(Loeffler) / no companion: reduces class rates for certain residential rental property.

Green Housing, Heating and Utilities

  • H.F. 2159(Westrom) / no companion: provides for utility rebates to homeowners for certain renewable energy projects used to heat a residence.
  • H.F. 0958(Olin) / S.F. 0961(Strumpf): authorizes state agencies to develop a plan for using federal stimulus funds dedicated to energy projects to install energy-efficient windows in government and residential buildings, to weatherize residential buildings, and to train installers; appropriates money.
  • H.F. 1131(Bly) / S.F. 0841(Dahle): requires study and report concerning disclosure of energy use of residential building owners, purchasers, and renters.

Housing for Veterans

  • H.F. 0541(Juhnke) / S.F. 0885(Erickson Ropes): extends the time frame for eligibility for the surviving spouses of certain disabled military veterans to receive the residential homestead market value exclusion.
  • H.F. 2098(Davnie) / no companion: appropriates money for ombudsman position at certain veterans homes.
